Indigenous Peoples Right to Free, Prior and Informed Consent: Reflections on Concepts and Practice

This paper explores the rights of Indigenous people in International law, through the frameworks of Free, Prior, Informed Consent (FPIC), and the World Commission on Dams (WCD). Reasons why FPIC is not always upheld in practice are explored through a series of case studies, and policy suggestions from the WCD are that prioritize the recognition of rights and assessment of risks are proposed to combat these problems.

This article examines how policy has developed to promote FPIC from 2000-2010 both as a human rights law and for extraction industry best practice. The article calls for more clarity around government power to control resource exploitation, since FPIC is not often upheld by industry and governments. The article also advocates for communities right to FPIC.
